Welcome to Are You SOS? ("the App," "we," "our," or "us"). By creating an account or using our service, you agree to be bound by these Terms of Service. Please read them carefully.
Important: Are You SOS? is NOT a substitute for emergency services. If you or someone you know is in immediate danger, call 911 or your local emergency number. This app is not a crisis hotline and should not be used in life-threatening situations.
Are You SOS? is a personal accountability app with three modes designed to help you stay connected with your support network:

When adding trusted contacts, you represent and warrant that:
When you add a trusted contact (Premium feature), they will receive an SMS asking them to confirm their consent to receive alerts. Contacts must reply YES to opt in. Only contacts who confirm consent will receive any alert messages. Contacts who reply NO or do not respond will not receive alerts.
Important: Trusted contacts must actively opt-in by replying YES to a consent request before they can receive any SMS notifications. This ensures compliance with carrier regulations and respects your contacts' preferences.
During account registration, you must check a box stating: "I consent to SMS notifications being sent to my trusted contacts if I miss a check-in." You cannot create an account without providing this explicit consent.
When you add a trusted contact (Premium feature), they receive an SMS consent request. Example:
"Are You SOS: [Your Name] wants to add you as a trusted contact. If they miss a check-in, you'll get an SMS alert. Reply YES to accept, NO to decline. Msg & data rates may apply. Reply STOP to opt out, HELP for help."
Only contacts who reply YES will receive any alert messages. This ensures explicit consent from all message recipients.
When you miss your check-in window, your confirmed trusted contacts receive an SMS alert. The message varies based on your selected mode. Examples:
Sober Mode: "Are You SOS: [Your Name] has not checked in to confirm their sobriety. Please reach out to them."
Okay Mode: "Are You SOS: [Your Name] has not checked in recently. They may need your support. Please reach out."
Safe Mode: "Are You SOS: [Your Name] has not checked in to confirm their safety. Please try to reach them immediately."
Emergency contacts receive a maximum of 1 message per 24-48 hour check-in period (depending on your selected mode). No marketing, promotional, or recurring messages are sent.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARE YOU SOS? AND ITS DEVELOPERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
The service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.
You agree to indemnify and hold harmless Are You SOS? and its developers from any claims, damages, losses, or expenses (including attorney's fees) arising from your use of the service or violation of these terms.
You may delete your account at any time through the app's Settings. Upon deletion, all your data will be permanently removed from our servers.
We reserve the right to suspend or terminate your account if you violate these Terms or use the service in a way that could harm others or the service itself.
We may update these Terms of Service from time to time. We will notify you of material changes through the app or by email. Your continued use of the service after changes constitutes acceptance of the new terms.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
